No waiver of any provision of these Terms will constitute a waiver of such provision in any prior, concurrent, or subsequent circumstance, and Dôen’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity.
Product Sales Terms of Use
In addition to the Website Terms of Use, these Product Sales Terms of Use (“Product Terms”) govern concurrently in connection with your product browsing, product shopping and any applicable product purchases from the Dôen Services.
-
Prices and Orders: The prices charged by Dôen will be those in effect on the date of receipt of your order. You agree to pay Dôen for all charges at the prices then in effect for the products and/or services you or other persons using your account or payment method may purchase, and you authorize Dôen or its designated payment processor to charge your payment provider for any such purchases. All US domestic payments are to be made in United States Dollars. US domestic posted prices do not include sales tax, which will be charged to you when applicable. Dôen reserves the right to correct any errors or mistakes in pricing that it makes even if it has already requested payment. Dôen disclaims any liability for damages or losses relating to any loss of profits or loss of commission as a result of business transactions not concluded due to price increases.
-
Product Descriptions and Availability: The inclusion of any products on the Website does not imply or warrant that these products will be available at any particular time or that the listed attributes are accurate or complete. Dôen continually upgrades and revises its products to provide you with new products. Dôen may revise, discontinue or modify products at any time without prior notice to customers, and products may become unavailable without notice. Dôen shall have no liability of any kind if a product that has been ordered is unavailable. If necessary, Dôen may cancel the order. In addition, we reserve the right, without prior notice, to limit the order quantity on any product or service, to refuse service to any customer, or to cancel any order, for any reason including after it is submitted. We also may require additional verifications or other information prior to the acceptance and/or shipment of any order. Your receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We accept your order only upon shipment of the product.
-
Corrections: We attempt to be as accurate as possible and eliminate errors on the Dôen Services, however, we do not warrant that any product or description, photograph, pricing or other information is accurate, complete, reliable, current, or error-free. In the event of an error, whether on the Dôen Services, in an order confirmation, in processing an order, delivering a product or otherwise, we reserve the right to correct such error and otherwise change or update the information on the Dôen Services at any time without notice, revise your order accordingly if necessary (including charging the correct price) and/or cancel your order and refund any amount charged.
-
Shipping; Return Policy: All purchases are subject to Dôen policies and procedures relating to shipping, delivery, returns and exchanges. You may request a refund or exchange if your product was damaged in transit, provided you make your request within 30 days of your fulfillment date. All decisions regarding such requests shall be determined by Dôen in its discretion.
To request a refund or exchange, please visit returns.shopdoen.com. Upon receipt of your request, Dôen will make a determination, in its discretion, whether a product claimed to be damaged or defective was actually damaged or defective when originally delivered to you and used as intended. Requests for refunds and exchanges will be reviewed and determined on a case by case basis. Dôen reserves the right, in its discretion, to refuse to refund or exchange any product.

-
Promotions and Coupons: In order to participate in or use certain services, promotions, discounts or coupons that may be run from time to time with respect to the Dôen Services ("Offer(s)"), you may be required to agree to additional or different terms and conditions ("Additional Terms"). Certain merchandise, costs or membership programs, and/or other benefits may be modified or not available in connection with an Offer. Your acceptance or redemption of any Offer constitutes your unconditional acceptance of the Additional Terms. If there is an actual conflict between these Product Terms, Terms and any Additional Terms, the Additional Terms shall control and the non-conflicting provisions in these all the Terms and Product Terms will continue to apply. For the sake of clarity, silence with respect to a particular term in either these Product Terms, Terms, and Additional Terms does not constitute a conflict.
-
Waiver; Remedies: The failure of Dôen to partially or fully exercise any rights or the waiver of Dôen of any breach of these Terms or Product Terms by you shall not prevent a subsequent exercise of such right by Dôen or be deemed a waiver by Dôen of any subsequent breach by you of the same or any other term of these Terms and Conditions. The rights and remedies of Dôen under the Terms or Product Terms and any other applicable agreement between you and Dôen shall be cumulative, and the exercise of any such right or remedy shall not limit Dôen's right to exercise any other right or remedy.
-
Product Claims Arbitration:
PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE PRODUCT DISPUTES AND CLAIMS WITH DÔEN AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.
YOU AND DÔEN AGREE THAT ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OR THE SERVICES SHALL BE FINALLY DECIDED BY BINDING ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION GOVERNING CONSUMER DISPUTES.
Arbitration uses a single, neutral arbitrator to decide a dispute (instead of a judge or jury); arbitration allows for more limited discovery than in a court case; and the arbitration process and result is subject to very limited review by courts. In an arbitration you have the right, at your expense, to be represented by an attorney of your choosing. Arbitrators can award the same damages and relief under these Terms that a court can award under these ProductTerms. You and Dôen agree that any in-person arbitral hearing would occur in the United States in the same county and state as your billing address. Dôen further agrees that your filing fee for an arbitration will be capped at the amount set by the American Arbitration Association. You agree that, by agreeing to these Terms, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Dôen are each waiving the right to a trial by jury and/or to participate in a class action. No demand for arbitration may be sustained after the date when the institution of legal or equitable proceedings based on such claim or dispute would be barred by the applicable statutes of limitation if this matter was filed in court. The arbitrator is authorized to dismiss the arbitration at any stage based on a determination that the claim is time barred or for any other legally or factually supported reason. This arbitration provision shall survive termination of these Product Terms and the termination of your use of the Dôen Services. Further, unless both you and Dôen agree otherwise, the arbitrator may not join or consolidate more than one person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
-
Products Class Action Waiver:
REGARDLESS OF THE FORUM, YOU AND DÔEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
-
